Can i claim land from a faction that i am more powerful than or is that a ban?

So basically this fac we ran into has lower power and i accidently claimed some of their land... i can unclaim but i wanted to see if i had higher power and COULD claim their land if that was allowed or not. I dont want to get banned so i wanted to see
